I'm not a lawyer but so think it's quite simple:

1. Players were given substances in an off site clinic as part of a performance program.

2. They signed waivers which listed vague substances which could be interpreted as either harmless or harmful, which were cleared by football departmentĀ whom the players relied upon (from duty of care perspective).

3. Players have documented record of soft tissue injuries consistent with unsafe variety of vague substances.

4. Club in effort to mitigate its and AFL culpability claim no records and that all substances given were safe, despite not being able to prove what they were.

Surely balance of probabilities would dictate that the substances given were harmful variety and if side effects linked to harmful substance variety includeĀ birth and childĀ development issues identified it should be pretty much an open/shut case.

Am I missing something?

    1. The waivers are probably no issue as there was a lack of "informed consent."

    2. Not knowing what the substances were is not a major deterrent except it makes it harder to prove that the damage is caused by the substance

    3. The damage itself can be an issue but let's assume you can show the "physical" damage and then monetise that damage.

    4. Now comes the big one and that is showing on the balance of probabilities that the substance caused the damage. One can show that a class of drugs is more likely than not the cause of the damage and that would get you home. If however the damage can be caused by multiple events common in the community other than ingesting the class of substances it is far from certain that on the balance of probabilities the player has proved that the damage is caused by the substance.

    Remember that while the defendant is in theory the club who may be sympathetic to the player and not argue liability etc, the person paying the money and who in practice gets to decide most things about how a case is run is the insurance company. I assume that LM's costs are at least to some extent covered by the AFLPA but because he could have costs awarded against him should he lose it is a major financial decision.

    The moral is of course that EFC have got off lightly in that even if LM is wrong in his claim the worry that the club has caused to LM and other players and their wives is absolutely reprehensible and unforgivable.

    They tried to cheat their way to a flag, but it is for the above reason that they deserve the eternal condemnation of the footy loving public.

    Going to court would take action from a player or the club, neither probably want the real answer. The AFLĀ and ASADA are powerless to get him to talk.Ā

    was thinking about the cheats last night - such is my hatred

    it's really annoying me that they are close to playing finals, but I comforted myself with the following:

    I reckon they would have won a flag or gone close in the last 5 yearsĀ if not for this saga. and they blew it by cheating! add in Ryder, Hibberd, Carlisle and the early draft picks they lost. Add in Watson /goddard/stanton etc being in their prime and take away all the distraction and controvsery

    hopefully now with Watson and Goddard being close to retirement, they will feel the loss of the draft picks and go back to the bottom 4 where they belong. Heppell is not a great leader imo and has had an average year

    I did a really bad fart that smelled better than this mob. Ā Why waste a moment thinking about them? Ā It is galling that they (the club, not the players) used every tactic to avoid responsibility. Ā Its even more galling that the AFL has never properly sanctioned the club because they are too pissweak and beholden to their favourites. Ā I hope they have the Jab Watson curse that lasts 100 years.

    Dangerous path, Chookrat.

    We've had more soft tissue injuries in the last few weeks than most if not all other clubs. Should we conclude that those players have taken an "unsafe variety of vague substances"? That's the conclusion your point 3 leads to.

    A salient point LDVC however I suspect if anyone were to approach the MFC Ā wrt to forensic evidence of what was taken and by whom I think we'd have ALL the appropriate paperwork.

    Not much credibility left other than with EFC supporters. A little like Lance it's not just what he did but the way he conducted himself post the scandal. Anyway like James he is escaping to a place where he can blend in with the crowd.Ā

    Agree,Ā now all the bummers fans will be out in force even more. Ā Just hope Adelaide come out and play there best.

      Having convincingly defeated last yearā€™s premier and decisively outplayed the runner-up with 8.2 in the final quarter, nothing epitomized the Melbourne Football Clubā€™s performance more than its 1.12 final half, particularly the eight consecutive behinds in the last term, against a struggling St Kilda team in the midst of a dismal losing streak.Ā Just when stability and consistency were anticipated within the Demon ranks, they delivered a quintessential performance marked by instability and ill-conceived decisions, with the most striking aspect being their inaccuracy in kicking for goal, which suggested a lack of preparation (instead of sleeping in their hotel in Alice, were they having a night on the turps) rather than a well-rested team. Letā€™s face it - this kicking disease that makes them look like raw amateurs is becoming a millstone around the teamā€™s neck.

      The Casey Demons were always expected to emerge victorious in their matchup against the lowly-ranked Sydney Swans at picturesque Tramway Oval, situated in the shadows of the SCG in Moore Park. They dominated the proceedings in the opening two and a half quarters of the game but had little to show for it. This was primarily due to their own sloppy errors in a low-standard game that produced a number of crowded mauls reminiscent of the rugby game popular in old Sydney Town. However, when the Swans tired, as teams often do when they turn games into ugly defensive contests, Casey lifted the standard of its own play and ā€¦ it was off to the races. Not to nearby Randwick but to a different race with an objective of piling on goal after goal on the way to a mammoth victory. At the 25-minute mark of the third quarter, the Demons held a slender 14-point lead over the Swans, who are ahead on the ladder of only the previous week's opposition, the ailing Bullants. Forty minutes later, they had more than fully compensated for the sloppiness of their earlier play with a decisive 94-point victory, that culminated in a rousing finish which yielded thirteen unanswered goals. Kicks hit their targets, the ball found itself going through the middle and every player made a contribution.

      Hands up if you thought, like me, at half-time in yesterdayā€™s game at TIO Traeger Park, Alice Springs that Melbourneā€™s disposal around the ground and, in particular, its kicking inaccuracy in front of the goals couldnā€™t get any worse. Well, it did. And whatā€™s even more damning for the Melbourne Football Club is that the game against St Kilda and its resurgence from the bottomless pit of its miserable start to the season wasnā€™t just lost through poor conversion for goal but rather in the 15 minutes when the entire team went into a slumber and was mugged by the out-of-form Saints. Their six goals two behinds (one goal less than the Demons managed for the whole game) weaved a path of destruction from which they were unable to recover. Ross Lyonā€™s astute use of pressure to contain the situation once they had asserted their grip on the game, and Melbourneā€™s self-destructive wastefulness, assured that outcome. The old adage about the insanity of repeatedly doing something and expecting a different result, was out there. Two years ago, the score line in Melbourneā€™s loss to the Giants at this same ground was 5 goals 15 behinds - a ratio of one goal per four scoring shots - was perfectly replicated with yesterdayā€™s 7 goals 21 behinds.Ā 
      This has been going on for a while and opens up a number of questions. Iā€™ll put forward a few that come to mind from this performance. The obvious first question is whether the club can find a suitable coach to instruct players on proper kicking techniques or is this a skill that can no longer be developed at this stage of the development of our playing group? Another concern is the team's ability to counter an opponent's dominance during a run on as exemplified by the Saints in the first quarter. Did the Demons underestimate their opponents, considering St Kilda's goals during this period were scored by relatively unknown forwards?Ā Furthermore, given the modest attendance of 6,721 at TIO Traeger Park and the team's poor past performances at this venue, is it prudent to prioritize financial gain over potentially sacrificing valuable premiership points by relinquishing home ground advantage, notwithstanding the cultural significance of the team's connection to the Red Centre?Ā
