Heh, the tribunal decision may bite them on the arse as it basically says no one knows what the hell was injected into the players.

What are Essendon going to argue to Worksafe? "Oh, uh, yeah we don't know what it was but it totally wasn't unsafe."

There will be massive fallout over this I think.

no doubt worksafe wiil (should) have a field day with essendon

but none of it will impact on players

and essendon's wealthy benefactors will pay all fines without blinking

so unless wada appeal and are successful 34 players will have got off scot free for being drug cheats

and, the sporting world will have a new blueprint for avoiding being caught cheating

You're probably right DC.

Things would have been very different if this happened to a club without such rich backers. They can afford to obfuscate and even pay fines if required.

It sickens me.

The HS article says that Worksafe are investgating becasue of a complaint from a member of the public.

If true it is a disgrace that they waited for this to occur when it was so public.

The new investigation is into afl ( suggesting they knew what was happening at efc clothiers meeting with hird,and did nothing)the member of the public is not john citizen but someone connected with efc and fed information . Efc wants the afl to go down if they go down.

yep, and you can't help but think essendon are having the last laugh and smugly claiming to be persecuted victims and claiming victory

essendon notables are the celebrities of the month and the media can't get enough of them

objective investigative journalism seems to have disappeared

and commentators and some politicians are calling for asada's blood

meanwhile gillom is sickenly doing all he can to rebuild relationships with essendon

Although part of me wants to hear no more of Essendon, James Hird and the drug scandal, part of me still wants retribution and to see the pain continue for Essendon, and, in particular, its coach who continues to show no humility or contrition. However, the part of me that still wants retribution is the winner. Let the pain continue for as long as it takes.

It might be simpler .

WADA presents to Cas whatever info exists re documentation and records.

Wada refers to EFC being unable to manifest them. Balance of probability suggests they were erased/destroyed.

Worksafe has even easier proposition ahead. Whether there were or weren't any records, they cant produce any now, therefore they can't show the welfare of their employees having been considered in an appropriate manner.

The vested interest of Worksafe in in the players ( health and safety )

EFC has some pain coming, right Max ?

I am sure if WS wanted they could subpoena Dank and the records he claims to have.

But I bet they won't.

If the hailstorm comes down on the club Directors they might then start proceedings against Dank - who after all was sacked for running the regime. As was Robinson. The Directors could be facing big fines and banning orders as I would if I tried that at my workplace...

I think you're trending the right path. It could very well BE worksafe who puts Dank in the box. The fallout could be spectacular :)

To be honest Lucifer, I would be happy to see the back of Hird. He is the one who really deserves the fall from grace and public humiliation. Having said that I cannot condone the players who went along with it. The judgement that the players are innocent participants is disgraceful. Try telling that to a professional cyclist operating under the strict rules of the international cycling federation.

Can't remember off top of head ( someone can kindly provide) what scope of fines are but the and/or jail bit can be u to 5 years.!!

Yeah its 5 yrs plus fines up to $180k each Director and 900k for each company I believe.

don't get too excited

they won't go for maximums

they will take into account prev afl governance penalties

they will take into account new governance rules in place

they will take into account anything else they can to deliver a wet lettuce.......i can just see it happening

Lance Armstrong was never proved to have been injected.

Lance Armstrong had a whole bunch of pele with intimate knowledge and involvement give evidence against him. Essendon have no such thing.

I'll assume the $900k fine would be for each offence. If 34 players were treated in a way which breaches OH&S laws, I wonder whether there is the potential for 34 separate breaches? Or whether there are hundreds or even thousands of potential breaches if each injection is considered to be a breach.

Having said that, I don't expect Worksafe to find sufficient evidence of any breaches of the OH & S Act other than some possible records keeping concerns. Assuming that Worksafe has to make a finding on a beyond reasonable doubt basis (any learned friends please correct me if I'm wrong) which is a higher hurdle than "comfortable satisfaction" I can't see how Worksafe can make a finding on the primary matter of concern which differs from the AFL Tribunal.
