Prominent Melbourne lawyer Tania Hird has launched a devastating attack on the decision by the World Anti Doping Authority to appeal against the AFL Tribunal's decision to exonerate 34 Essendon players charged with using prohibited drugs in 2011 and 2012.

Claiming that it was disgraceful and unconstitutional for a party to a dispute to appeal against any tribunal decision, Hird described last Tuesday when the WADA appeal decision was announced as, "the blackest day in Australian law".

-If the AFL Tribunal had found against the players would they not use the very same 'unconstitutional' process to appeal to CAS.

Tim Lane absolutely smashed it out of the park in the age. His point is best proven by the antics on the footy show deriding WADA, the reaction of leaders in the game such as Eddie McGuire. They all just want it to vanish with no need to actually know what happened.

No HIgh Court here. It stops at CAS for everyone, whichever way it goes. No further appeals.

They are smarting because ASADA outsmarted them all!

They thought if ASADA wasn't happy with Tribunal they would next go to another AFL Tribunal (as the process allows) and appeal the decision. The EFC and AFL PR machines would then go into overdrive with the 'we are innocent', 'waste of public money' etc campaign and whip up a local frenzy to see it get it buried once and for all. Hoping that by then WADA would also have had enough.

ASADA didn't fall for that trick! They called the bluff and passed to let WADA take the lead.

AFL/EFC are now smarting in not foreseeing the ASADA/WADA strategy which explains why they were all so shell-shocked on Tuesday.

They are also sh-- scared because in reality it is not the Tribunal decision being appealed it is a brand new case.

What the mr hired senior and the rest of the ess side don't explain to the rest of us is, WHY asada are out to get essendon, they would have us believe, that asada's persistance is borne of spite, nothing else. Really?

If the Hirds feel it is against the constitution, by that I mean Australia's, it would need to be challenged to the high court on the basis of the case not being in line with our constitution. It would be a hearing like the Hird one to the fed court, not actually about if they did it, but more about how it will be heard.

The urging of former AFL Players Association legal adviser Graham Smith that the AFL remove itself from WADA is in the same category. I would not be surprised if his interview was scripted. An early shot in a long campaign to paint WADA/ASADA as cowardly, vindictive, un-democratic foreign meddlers and un-Australian as a causa belli for a possible AFL departure from the WADA code. All his words appear too well chosen.
