I suppose getting the EFC to fund the appeal makes the most sense. No out-of-pocket legal fees, and no harm done if the decision isn't overturned because you can still turn around and sue EFC anyway.

The entertainment keeps rolling on. Will it never end?

I'm starting to hope they get their injunction and have to start their suspension all over again!

And that Jobe gets to keep his medal only to have the AFL rip it off him months later due to public outcry.

Hopefully Melksham sees sense and just takes the 12 months off and doesn't risk the extra year, especially if an injunction isn't granted and he has to sit out this year anyway.

I have a sneaky suspicion that if they do get an injunction and play this year then the booing of Goodes last year will seem like a welcome home celebration in comparison to what these boys will get.

I love the line that the players took nothing illegal and if they did then they were duped by Dank.   The former has been decided against them by CAS.  The latter calls for only one response -  sue Dank.

It's understood the players have not sought an injunction, meaning they will remain suspended this year.

Essendon saga: Players to appeal to Swiss court against Court of Arbitration for Sport verdict

So they will miss the season. What do they stand to gain? This is a lawyer driven money fest. If they win they will sue everyone, if they lose they will sue the AFL & EFC in the mean time the lawyers pocket the money. 

This is a disgrace. Another year stuffed up by the drug cheats, I hope they get a greater penalty if that is possible.

Had a browse on bfessendon to see the reaction to the appeal and noticed this from none other than out occasional interloper, 'Lance Uppercut':  "...And yeah, I've been pretty open about the fact I think the CAS probably came to the right decision, but got there in a very strange way..." 

He hasn't been back to DL since the CAS decision but kudos to him for taking the suspensions on the chin.

Reputational enhancement. At the moment they are considered "officially" guilty of taking illegal substances. If they win the appeal they won't be. But nothing will really undo the damage they have already sustained in the eyes of the general public, unless the appeal unequivocally states CAS was wrong and there is absolutely no evidence whatsoever of wrongdoing. A big ask, I would have thought, even if they win.

I think the general public is sick to death of this saga. They will forever be tainted. Interesting that the insurance company is funding the appeal, they must be very afraid of all the law suits coming their way. The legal fraternity must be licking their lips.

I just heard Chip LG speak and he said the appeal is not based on the evidence or the decision.  They are appealing on a technicality - jurisdiction and CAS's right to hear the case 'de novo'.  So even if they win it won't clear their names.  If they really believed they were innocent they would appeal the decision and the evidence.

It is the same Hird's/EFC  challenge in the Fed court on a technicality ie the legality of the AFL and ASADA doing a 'joint' investigation.  It was (and Hird's later appeal) emphatically turned down. 

I'm a bit over their attempts to use 'the law' to get out of accepting their guilt as if technicalities will erase the taint of being cheats.

Let's hope the player appeal is thrown out of the Swiss court just as emphatically as Hird/EFC in the Fed court!!

On that basis, I doubt they will even get to have the appeal heard at all. In other words, their next step ie having CAS give permission for the appeal to be heard, won't happen. I think a previous poster hit it on the head when he said if this is being funded by the  EFC insurance company, then they must be terrified of what comes after. And so they should be. 

The last desperate throw of the dice I would have thought.

    A few new faces joined our veteran Demonland Trackwatchers on a beautiful morning out at Gosch's Paddock for another Preseason Training Session.     Meggs' Review of Melbourne's AFLW Season 9 ... Congratulations first off to the North Melbourne Kangaroos on winning the 2024 AFLW Premiership. Roos Coach Darren Crocker has assembled a team chock-full of competitive and highly skilful players who outclassed the Brisbane Lions in the Grand Final to remain undefeated throughout Season 9.
