No, it sounded recent - like something someone from Carton club had said or something going around on social media.

The EFC statement:-

Essendon Football Club is understandably disappointed at todays Federal Court decision.

Before deciding the next steps, we will consider the reasons for the final judgement, including whether or not to appeal this decision.

In taking these proceedings, our priority has been to protect and vindicate the legal rights and interests of the players.

The Club maintains its confidence that, on all the evidence available to us, neither harmful nor banned substances were given to the players during the supplements program of 2012.

Out of respect for the competition and the Clubs still competing this season, it is not our intention to provide any further commentary on this matter beyond today’s statement.

Next. I can't see how the AFL can avoid giving them severe sanctions for running a drug cheating regime.

Little made sure that he protected what was left of Hird's reputation by insisting in the settlement last year that it expressly said there was no suggestion of drug cheating and the sanctions were expressly only for poor governance. Can't possibly see how the AFL can avoid giving them very serious sanctions otherwise the reputation of the AFL as a sport will be more damaged than anything that is going to happen to Essendon.

This case has set another unrelated but incredibly significant precedent. The Judge referred to the fact the players had entered into binding contracts with the AFL to be investigated and give up their right to avoid self incrimination and that contractual agreement is binding. This is the first time these contracts have ever been commented on in the Courts. The significance of this is that the court is saying the Clubs and Players contractual obligations with the League are binding. These contracts include the salary cap and the draft. In the past there have been rumours of threats by Eddie No Where that if he didn't get what he wanted he would get the salary cap etc set aside for being anti competitive but the Court is saying if you sign a contract to be part of the AFL it is binding. People have often wondered what would happen if a player or Club took it to court. Well here is the answer.

That obiter dicta may have bee influenced by the introduction of free agency, it being assumed that players are not locked into endless contracts at the best of the clubs.

I guess it depends. Maybe they were just trying to delay everything for as long as possible.

Because I am a notorious sticky-beak I set up an account on bomberblitz when this all started. So I can see into the inner sanctum.

I think that must be their strategy. It is always possible that a stupid litigant will instruct his lawyers to pursue a foolish case regardless of advice, but there are surely enough people at Essendon to have intervened to stop that. So dragging things out for years might well be their strategy. Might even been seen as club bonding - us against the world etc. The AFL which doesn't want a 10 player Essendon team next year may be quite happy for this to go on for years in the background too.

But it carries risks. A few cracks could become rifts, Ryder's could abound. But maybe that is less to them and the AFL than the risk of having a decimated team in the short run.

These costs will pale into insignificance once the 34 players eventually take Essendon to court for compensation. Failing in their duty to provide a safe workplace, loss of earnings and inability to pursue their careers, pain and suffering due to stress and pressure that the elongated denial of responsibility that Hird and Little are happy to continue and so on and so on. Where are they going to find the money? Will the afl bail them out? Only a miracle can save this club. I feel sorry for their players and supporters. Well Hirdy sit back and count your money and Little enjoy your business interests. There may be a place for a Tassy side shortly.
