I would have thought no dank, No Alavi, No Charters actually hurts Essendon, not ASADA. ASADA have their evidence. Essendon will find it hard to refute or offer anything else substantiable as their corroborating witnesses wont show up.

I think this is it. If ASADA's evidence points to a chain of custody for TB4 btw Carter, Alavi, Dank and that the Consent forms reference Thymodin withput being clear on whether the good or bad stuff, the onus would be on EFC to provide evidence that they purchased and used the good stuff.

That the EFC haven't attempted to subpoena Dank as a former employee adds weight that they don't want him to provide evidence. Adding to this the ridiculous notion that they did not keep records for a 'legal' injection program.

I also think the EFC will be hard placed getting off on a technicality given that the burden of proof is confortable satisfaction only.

Hopefully this saga will be over in January so that we can enjoy the build up to the season proper without the lies and mischief that we see too much at work and in politics, without seeing it in our National sport.

And to add to that, Dank is also a defendant here. If he doesn't show (likely it seems), then the "adverse inference" rule comes into play for him, the consequences of which would presumably flow on to Essendon. (e.g., if he's found guilty of possessing TB4).

Charter has already said that ASADA's evidence from him is mainly documentation, and that they have all they need anyway.

Hard to see how it makes a difference to ASADA's case.

Jess claims senior AFL figures breached their duty of care to the “Essendon 34” by failing to intervene in the club’s ill-fated 2012 supplements program.

“This saga should never, ever have reached the position where it is today,” Jess said.

“The AFL has been negligent, absolutely from start to finish.”

I continually find myself choking on my breakfast cereal when I read this stuff. Essendon of course wasn't negligent they're just hard done by, lovable, bumbling record keepers. But wait a minute...they haven't taken anything illegal have they?... so why is he so upset?

Just for my own sanity.....Essendon FC organised an ongoing, systematic, drug use program that produced obvious onfield results and perhaps, given muscle growth, ongoing advantage. Negligent YES, Cheating YES. Last time I looked it wasn't up to the AFL to make sure clubs werent using drugs. its the CLUB and the players.

AFL and EFC leaks are one thing.

Ex-County Court judge leaks are another. And they are the guys that count here.

There is daylight between county court judges and a twit that managed to pass the bar but has hardly ever been briefed. Even being on the AFL tribunal is out of his league. I wonder if he has ever been inside the County let alone the Supreme court before.

So they will be suing the AFL and not Ess for breaching duty of care? Wtf?!

I assume its because their employment contract is with the AFL and not Essendon.

You obviously havent been paying attention..lol.. They are not employees they have a commercial agreement with Essendon and its written on a standard AFL template contract.

Thought I read somewhere that all contracts were with the AFL and thats how the Essendon players were require to talk to the AFL/ASADA investigators.

Sorry BB I must have missed reading this information in the 500 pages of the previous thread. This omission is clearly the fault of the AFL and ASADA.

I will write to them to ensure that I am better informed about the Drug Lords in the future.

Moose Henwood is unfortunately one of the judges in this matter. We've seen him before when he found Jack Viney guilty (which was dismissed on appeal).

I dont think either side would consider him to advocate their cause.

But he is an AFL tribunal member and in this case is sitting in judgement. So anything is possible.

Shocked to learn that the same bozos who usually sit on the tribunal would be let anywhere near such a serious case as this. Shocked, but alas, not surprised.

Never thought I'd say this, but I just want this to end now. Don't get me wrong, I'm loving the Essendon tears, but it's just dragging on and becoming tedious.. On the bright side though the druggies are in for a decade of pain, and a bad rep that will last a lifetime, regardless of the outcome

    A few new faces joined our veteran Demonland Trackwatchers on a beautiful morning out at Gosch's Paddock for another Preseason Training Session.
