Are you perhaps suggesting that were he to be jailed for his involvement in this heinous breach of workplace responsibility he may not find it an altogether pleasant experience? Maybe he will seek political assylum in France.

The players still have an out. They respond to the show cause notices saying:

I asked for that in writing, and it was provided. I believe I did my due dilligence to ensure any substance administered was legal according to the WADA code. If it is proved that I was administered a banned substance this is through no fault of my own and I went above and beyond what I normally would to ensure the substane was legal."

I'm not sure that is right. Let me give you a scenario. I am a Chinese swimmer. My doctor tells me to take special natural supplements. I check with my Doctor who says "you are fine to take these". I train like mad and win an Olympic gold medal. I am the pride of my nation.

Then it turns out my doctor has been ordering illegal substances from a chemist. My doctor has correspondence with my coach saying in effect "we got the good stuff because we are going for an olympic gold medal." "Hey you had better get swimmer x to sign a consent form". My swim team has an unprecedented number of soft tissue injuries.

My swimming association makes a statement saying they have been giving swimmers supplements. They don't know what the substances are but they could be illegal. The coach we employed has a chequered past and we don't have records of what he gave our swimmers. I am accused of taking banned substances. I plead my innocence. I did everything in my power to check the substances were WADA compliant.

I lose my gold medal.

Is there another alternative that doesn't sully the sport?

Players have no real out.

They do have some outs.

If ASADA can't make out a case to the comfortable satisfaction of the ADRVP they have an out (unless there's a successful appeal to CAS).

If ASADA proves to the comfortable satisfaction of the ADRVP they had TB4 in their system then they have another out but only if they can prove it was injected while they were unconscious and without their knowledge or consent.

Both are highly unlikely.

If anyone wants to trawl back a long way in this thread, it has all been discussed many times before.

There is no evidence of any deals or agreements about the players being absolved and if Essendon or they believed otherwise, they are/were delusional.

To the extent that there was an understanding between the AFL though David Evans about leniency towards the players through self-reporting, neither of those persons are in the positions they previously occupied and the reality is that the current Essendon leadership has burnt its bridges and is seemingly taking its club and its players down in the flames.

It's a tragedy for football that has its beginnings at some time in late 2011 when a decision was made to test the limits of sports science - a bad move that now sees a once proud and well respected club careering out of control.

I totally agree with this.

As far as I understand the situation, the players cannot be found to have "no fault or negligence". There may be scope for "no significant fault or negligence" which reduces it from 24 to 12 months.

This would be case by case, and ASADA would need to be pretty satisfied that the players did try, they did check but they were tricked. Would it hold up? I'm not sure, but it is conceivable within the rules.

The possible 6 month ban that had been mooted assumes reduction to 12 months for "no significant fault or negligence" then reduction to 6 months for "cooperation".

Right now they have lost any chance of the latter. And by refusing to play ball and respond to show cause notices they are losing any chance of the former.

Bwaah. It's ASADA's fault. It's WADA's fault. It's the AFL's fault. It's all wrong, the legal expert says the Dons will win their case (did they mention he's done work for the Bombers in the past and supports them?) and besides, I feel sorry for the players who were just following orders from the golden boy. Should I add that he has such a lovely wife who's good at taking notes?

Essendon players issued with show cause notices still waiting for ASADA to present evidence

Grant Baker reporting in today's Herald Sun that ASADA hasn't presented any evidence of the case against them. The thing is that their club has instituted proceedings against ASADA which, if successful, would make what they want unnecessary so there's absolutely no hurry whatsoever on the part of ASADA to comply with the request. Of course, the clock continues to tick and if the Bombers fail in the Federal Court, the players will have lost valuable weeks or months in which to serve the minimum penalty of 6 months if it applies. As Gillon McLachlan pointed out on On The Couch, the timeframe for this to be played out is now in the hands of the lawyers.

Funny, might be just me, but I thought it worked.

Will the Demons celebrate Clayton Oliver’s 200th game with a victory? We have a number of callers waiting on line … Leopold Bloom: Carlton and Melbourne are both out of finals contention with six wins and eleven losses, and are undoubtedly the two most underwhelming and disappointing teams of 2025. Both had high expectations at the start of participating and advancing deep into the finals, but instead, they have consistently underperformed and disappointed themselves and their supporters throughout the year. However, I am inclined to give the Demons the benefit of the doubt, as they have made some progress in addressing their issues after a disastrous start. In contrast, the Blues are struggling across the board and do not appear to be making any notable improvements. They are regressing, and a significant loss is looming on Saturday night. Max Gawn in the ruck will be huge and the Demon midfield have a point to prove after lowering their colours in so many close calls.
