AFL records theft arrests madeBy staff writers and wires

August 27, 2007

POLICE said tonight they had charged a man and woman with theft in relation to medical documents reported stolen from a rehabilitation centre.

The pair, a 36-year-old man and a 31-year-old woman both from Ivanhoe West, have been charged and bailed to appear in Heidelberg Magistrates Court in Melbourne on October 31.

Seven aired controversial allegations involving an AFL club and its players on Friday.

Does this mean Seven will be charged with receiving stolen goods?

i am not interested in allegations, medical records or what was said.

but you make a good point here. if 7 knew the records were stolen they could be in all sorts of problems...considering they paid for the documents.

and given this is the case, i guess we are never going to hear officially what was in them...

I don't practice much in the criminal law field these days but my recollection of the law is that the person who obtained them doesn't even have to know for sure that the records were stolen. It would be sufficient if he/she reasonably suspected that they were stolen or unlawfully obtained. However, the authorities might decide it's all to hard a case to prove. Redleg might be able to add some light with his vast knowledge of crime and the criminal mind?
