Actually, if there is no eyewitness to confirm identity I would have thought it was a good defence. Mind you, if the defendant did what he is charged with, I hope the jury has sufficient circumstantial evidence to find him guilty.

 

Such a joke of a thing, the mistaken identity defence...

Hopefully you never get accused of something you didn't do.

Identity is crucial, cast enough doubt and the prosecution is in trouble.


Defence lawyers are not supposed to come up with an actual defence, they are supposed to relay to the court what happened (according to their client).

Seems a chance that the defence client remembered what happened after they saw a possible flaw in the video.
