Although the Essendon contract has nothing to do with his latest posturing about Bock and the Suns. Dank now claims to be intending to sue the Suns for wrongful dismissal so I assume he'll also be having to claim that he was an employee, not a contractor.

Except that there's nothing in the amendment that restricts the CEO to issuing a notice requiring only (a) or (b) or (c). But I agree otherwise: no matter what the law says, Dank and his lawyers will be quibbling/arguing/stonewalling for as long as they possibly can.

The 2013 amendment says (in part): (1) The NAD scheme must authorise the CEO to give a person a written notice (a disclosure notice) requiring the person to do one or more of the following within the period specified in the notice: (a) attend an interview to answer questions; (b) give information of the kind specified in the notice; (c) produce documents or things of the kind specified in the notice. That's not restricted to turning up to an interview, it requires providing information. As to who a 'person' is for the purposes of the ASADA legislation, I can't find any definition and I can't see why a 'person' would necessarily be restricted to someone signed up to the code. That's why I'd be interested in the views of one of the lawyers about the place.

They do now (introduced in 2013). I don't know whether they can use them for events/investigations begun before that year. They couldn't in the EFC case because of timing although this was stepped around, at least with the players, because of the AFL's powers. Hopefully one of the lawyers around here can add something, but I'd hope that Dank's claims might allow ASADA to declare their investigation a new one and use their current powers, including compulsion. Would love to see Dank hoist with his own petard ... syringe.

That’s all well and good, Ernie, but how about telling us where that last, great unpublished manuscript of yours is. We could make a fortune out of it, enough to keep all the ratbags (as you call them and who am I to disagree?) on this thread in bananas until MFC finally wins a flag. Presumably it’ll need a bit of updating for publication in these strange times. I’d suggest you let Biffen loose on it to toughen up the language (you’ve been getting just a bit too sentimental in your old age if your posts here are any guide). And BBO will obviously be able to provide plenty of advice about those things you might not be so familiar with in terms of modern … err, relationships, for want of a better word. I’m happy to volunteer as a pale imitation of Max Perkins if required (for a healthy fee, obviously) but I think those two should sort out most of the issues for you.

One of the commentators at the Swans game quoted Bob Skilton, who said that Max was the most naturally talented player he ever saw (or was it played with?) Looks like a few of the right genes got passed along. Bugger.

That Payet fee kick! Preposterous. Hope the Hammers make the FA Cup final so he can do something like that again on the big stage. Arsenal have worked out how to win again but I suspect it's probably too late. The extent of their ambition will now be to get past Spurs ... for which they might also be too late.

It's probably unlikely but jeez it'd be fun if the Swiss Federal Supreme Court issued a ruling within the next 48 hours or so that there are no legitimate grounds on which to hear the appeal against the CAS ruling.

A question of whether I'm overestimating or you're underestimating, Mr Shadow. Of course I'd like to think Uncle Bitters would confine himself to the techniques of correction he's familiar with, but I can't help but worry that one way or another he'll get ahead of himself. Then there'd be two of him, a situation surely to be feared.

Moonie, I assume you are aware of the relationship between the words moderator and moderation. I raise this not because of any concern that Uncle Bitters might be considered too immoderate in his many (ahem) tastes and behaviours but for the very opposite reason: to identify the possibility – fear, I suppose – that he might end up abandoning his immoderations altogether. Do you really want that sort of future for Demonland?
