Cousins Question

Featured Replies

Earlier in the year a Dylan Howard reported he had the medical records of 2 players from a certain club that had twice tested positive for recreational drugs. The AFL sought a Supreme Court Injunction to prevent the Australian media from repeating the claim. How come they don't do the same thing for Cousins and the LA medical records?

I realise that he has a serious problem but now that both charges against him have been dropped he should be allowed the same privacy as every other player in the compettion and eligble for the pre season draft, not that any team would pick him up.

How can an Australian court have jurisdiction in the USA?

They don't. They do have the power to prevent the Australian media reporting medical records just as they did ealier in the year for the players we cannot name.

Was it a case of reporting on Cousins disposition in the LA hospital rather than the release of medical records?

In any case an Australian court could only rule on the publication of the records in the Australian media not the release of the records by the LA hospital. If the records are reported in a foreign media outlet I am not sure how the Court can reasonably suppress the data.

The original news report I saw showed what they claimed were his medical records with a black mark over the name of the patient
