  1. at the time of the asada investigation dank was no longer an employee of essendon given the pathetic powers asada had they couldn't touch him or demand anything of him in fact none of the essendon employees could be compelled to give evidence. that's why asada partnered with the afl who did have those powers this all goes to show that asada need more powers if they are to have much chance in catching cheats other than with urine/blood/hair tests sadly there is more chance of hell freezing over than asada being gifted more powers of investigation

  5. yes, these have been used before in the vfl/afl certainly good for the cuts and self confidence
  6. another interesting aspect if they used excel for their spreadsheet, then every time they closed the spreadsheet the new spreadsheet is written as a new temp file, then when completed, original file is deleted, then temp file is renamed to the original file. therefore, assuming the spreadsheet was updated 1,000s of times (likely) there would be 1000,s of versions of that spreadsehet on disk. i.e. one active and 1000,s deleted with such a heavily updated file, if you were trying to foil forensics you would keep the file on something like flash memory stick (easily destroyed). alternatively if kept on the laptop's hard drive you'd need to remove and destroy the hard drive to be perfectly safe or use some easily available heavy duty disk cleansing tools, but just removing hard drive would be quickest and probably cheapest assuming it was dank's laptop he'd probably have just taken it with him. if he gave copies to anyone at ess he would be smart enough to keep them off the corporate servers, and probably used flash mem sticks. these could be quickly disappeared. i'd be very surprised too, if dank hasn't still got a copy for his own use
  7. well even if you found traces of such a file existing, or even traces of some data, or evidence of it being deleted (files commonly get deleted/recreated/redeleted etc in normal operations anyway) it would be worth nothing unless you could accurately recreate the appropriate (tb4) cells (multiple rows and columns) plus headings . and as someone has pointed out before it is most likely that the appropriate cells were disguised by some euphemistic text anyway

  11. essendon never "just handed over documents" all handovers were documented by legal eagles on both sides following well established procedures using deloittes under contract both sides would have copies and fully documented receipts hird could be sued for his pathetic comments

  13. maybe they did but the tribunal employed (imo) a more "beyond reasonable doubt" thinking rather than "comfortable satisfaction" i doubt any of the tribunal members had experience with "comfortable satisfaction" and were themselves "uncomfortable" with such an alien (to them) concept matters were not helped by the tribunal being held in camera and little public release of all their findings, so to comment that "asada didn't join the dots" is just pure conjecture
