  1. Final hearing date is 11 August which, if a decision is handed down on the spot there are only 3 home and away rounds left. If the players take the 6 months apparently on offer (assuming it applies) after the hearing, they will be missing a fair slab of 2015.

Franky - ASADA and the AFL (and consequently its clubs, staff and players) have an agreement in place which essentially states that matters relating to anti-doping violations will be investigated by ASADA and a separate panel will then determine whether there is a case against them. If that happens, it's up to an AFL Tribunal to consider the evidence and apply sanctions if applicable. The world body WADA has the right to appeal any decision which it is not satisfied with - the appeal goes to the Court of Arbitration in Sport (CAS). The parties have contracted that the procedure is outside our sovereign law and the WADA Code (and not our common law) is paramount. However, there is a limited right based on sovereign administrative law for parties to take issues to our local courts - in this case the Federal Court where Essendon is claiming that ASADA has acted ultra vires or outside the scope of its remit and therefore, to allow ASADA to apply the results of its investigation process to further the case against the players amounts to a denial of natural justice. There is a directions hearing set for tomorrow in the Federal Court which will deal with matters of how the court's process in dealing with the case is to proceed all the way to a hearing. Issues to be discussed are likely to be the outline of each side's arguments. whether mediation is to take place, what documents need to be produced, what witnesses will be involved, whether the players should be joined in the proceedings, final written statements and submissions and the setting of dates for the hearing. At one stage there was talk that the matter would take several months to reach the final hearing stage but latest reports suggest it will be set down for a date in August. The Court might not make its final decision known on the day of the hearing. As to what happens with Dank. Who knows where he's going to be by August? I don't think it's going to be in as good a place as Paris.
  8. ASADA hasn't outlined its case against the players but they should have a fair idea now as to what it's all about. They have received show-cause notices and what they have to do now is simply tell the truth. What do they know about the supplements programme they were subjected to during 2012? ASADA wants to expose and charge Dank and any other Essendon official complicit in the programme. The co-operation of the players is likely to result in sanctions against these men. Yes, it will also result in infraction notices against the players involved as well but they have the opportunity to minimise the sanctions against them - a chance that might not otherwise be available if they don't act soon. What I'm advocating for the players is obviously problematic for the players and their advisers. We're not a nation of "dobbers" and in the general scheme of things we don't like self-incrimination. Co-operation would also hurt and possibly deeply wound their employer as well. We're also not a nation of drug cheats either and while I believe most of the players didn't intend to cheat, they certainly failed to be vigilant enough about what went into their bodies which is what is drummed into them on a regular basis as AFL players. Chris Judd spoke earlier this year about players being "capable of individual thought". "If someone said to me you are going to have multiple injections off-site at an anti-ageing clinic, I would be able to say, no, that doesnt sound right for me. "Real heroism is when you are able to stand up and be different to the crowd, when you get that feeling in your stomach that something is not right." The players still have the capacity to ensure that by standing up now they can avoid some very hefty sanctions and a lifetime of carrying the label of "drug cheats".
  9. Not really given that he had the same number 6 beside his name when the equivalent list was released a week ago. If he is moving forward with the injury it's at such a slow pace that we're not likely see him in action for some time yet.

In the first place, Frawley has been a loyal servant of the club and any collusion to achieve such a result would be seen as a low dog act in similar vein to the little creep who was once accused of lying to our dying club president. And secondly, the new AFL CEO is well known for his desire to run a competition with "integrity" and I'm sure he would see draft tampering written all over such a proposal and ask some probing questions and make the appropriate rulings.

I think most reasonable people would consider the desired outcome to be one that involves uncovering the truth and achieving a result based on an application of the rules established by the anti-doping code. That's what happens the world around and I don't think athletes in this country should be treated differently to those of any other part of the world whose sporting bodies subscribe to the code. It's that simple.

Actually, getting the desired answer is the best outcome but many are not interested in the fact that ASADA needs to properly follow the principles outlined for it in relation to the issue of Show-Cause notices and it may not be able to do so until it has received the appropriate legal advice. Given the tendency of one or two parties to litigate the issues involved here which aren't helping anyone arrive at the right answer, I think ASADA is following the correct course. But some here are not interested in that.

Essendon players issued with show cause notices still waiting for ASADA to present evidence Grant Baker reporting in today's Herald Sun that ASADA hasn't presented any evidence of the case against them. The thing is that their club has instituted proceedings against ASADA which, if successful, would make what they want unnecessary so there's absolutely no hurry whatsoever on the part of ASADA to comply with the request. Of course, the clock continues to tick and if the Bombers fail in the Federal Court, the players will have lost valuable weeks or months in which to serve the minimum penalty of 6 months if it applies. As Gillon McLachlan pointed out on On The Couch, the timeframe for this to be played out is now in the hands of the lawyers.

  17. They do have some outs. If ASADA can't make out a case to the comfortable satisfaction of the ADRVP they have an out (unless there's a successful appeal to CAS). If ASADA proves to the comfortable satisfaction of the ADRVP they had TB4 in their system then they have another out but only if they can prove it was injected while they were unconscious and without their knowledge or consent. Both are highly unlikely. If anyone wants to trawl back a long way in this thread, it has all been discussed many times before. There is no evidence of any deals or agreements about the players being absolved and if Essendon or they believed otherwise, they are/were delusional. To the extent that there was an understanding between the AFL though David Evans about leniency towards the players through self-reporting, neither of those persons are in the positions they previously occupied and the reality is that the current Essendon leadership has burnt its bridges and is seemingly taking its club and its players down in the flames. It's a tragedy for football that has its beginnings at some time in late 2011 when a decision was made to test the limits of sports science - a bad move that now sees a once proud and well respected club careering out of control.

Robbo mentions the word "propaganda" and I agree there's been an awful lot of that going around but most of it emanates from the Essendon camp. Given that he released the names of some of the Essendon players said to be involved he's got a real hide complaining like a stuck pig about their treatment.
