July 2013 In a statement released to the Australian Stock Exchange on Monday, Metabolic's parent company Calzada Limited said it "categorically refutes" any suggestion it had been involved in secret drug trials involving Bombers players. "Metabolic has not been involved in any human clinical trial activity since early 2007," the statement read. "Metabolic has never commissioned third parties to use AOD9604 for the purpose of generating patient data or any other purpose. "Furthermore, Metabolic does not manufacture, supply or sell AOD9604." The company did confirm the existence of "four case notes" linked to professional football players using a topical cream. "The four case notes relating to 'professional footballers' all involved use of a topical cream form of delivery, not injection." The company said it became aware of a growing black market in the use of AOD9604 in 2010. It insisted that while Dank agreed to document a number of historical case notes in September 2012, the treatments were not commissioned by Metabolic, which owns the Australian and international rights to the drug. It said a report from Dank in November 2012 on 25 case notes assessing the biological function of AOD9604 only recorded historical anecdotal information. "In no way do these notes constitute a clinical trial," the statement read.

Property developer Mario Salvo, a long-time friend of witness Shane Charter, arranged crucial talks between the biochemist and senior club figures as the AFL tribunal hearing approached. Charter then turned on ASADA, even briefing Essendon lawyers about what he knew of the ASADA case and adding new material to his version of events. ASADA ultimately failed to convince an AFL tribunal that 34 current and former Bombers had used a banned drug, in part due to problems with witnesses including Charter. “I facilitated a meeting between the barristers and (Bombers chief executive) Xavier Campbell and Shane Charter,” Salvo told the Herald Sun.

This columnist managed to upset some Essendon folk when, after Watson's admission in June 2013 of having been administered the anti-obesity drug AOD-9604, I wrote that Watson would have to forfeit his prized award. Bearing in mind last Tuesday's tribunal decision, and barring a successful appeal by ASADA or WADA, it's now unlikely this will be required. Apologies have been demanded. That comment piece was never intended as a moral judgement, merely a logical joining of dots. On April 23, 2013, the World Anti-Doping Agency (WADA) had issued a statement making it clear AOD-9604 had been a prohibited substance since 2011. WADA declared the drug "Prohibited in all circumstances." Former ASADA head Richard Ings commented at the time: "My reading … is that the use of AOD-9604 from 2011 onwards would be classified as a doping violation." However, as we were to learn, contrary information had been conveyed to Essendon on the status of AOD-9604 and, as a result, ASADA didn't pursue an investigation of its use. But the AFL, as we know, is bound by the WADA code. The point of that column of June 26, 2013, was that a breach of the code would inevitably put a player on the wrong side of the "Fairest" criterion by which the Brownlow Medal is judged. If we're talking a specialist physician, the only person I would trust to have sufficient expertise in an area as complex as endocrinology, they must do a minimum of 5 years university, 1 year of internship, 3 years of basic physician training, 3 years of advanced training, and likely a year-long fellowship. That comes to a minimum of 13 years, just to get your foot in the door. This compares to Dank's 3 year undergraduate degree, and an incomplete Master's degree. After this he pursued a career selling dodgy genetic testing to gullible sporting teams. He is a pseudo-scientist. He's a shill, a snake-oil salesman, a charlatan. . . . Dank was apparently well enough qualified for Hird to turn him loose on the playing list!!
  17. Do we have any detail of the charges ASADA have laid against Dank? Is there a possibility that tribunal findings against Dank could lead to charges against the Club and other "support" staff?
