  2. I agree, end of first round is a reasonable outcome. And yes I know we need to get over what we didn't get, but I would expect the AFL would need to clarify why there is a difference here, after making such strong statements against the pp in our case. A plain, simple, cohesive and acceptable explanation is warranted. Somehow I doubt we'll get one though. It's not the result of Brisbane getting a PP I can't stand, it's the hypocrisy (of both the AFL and the Lions, who argued so vehemently against us getting one).

  4. From memory, reports said the text messages exchanged actually used the word 'injection'. Something like 'did you get your thymo injection today?' I think. Not sure about if there are other delivery methods.
  5. I agree with everything here except the last line iv'a. As I think I said in the Melksham thread, the players' lack of disclosure on their ASADA forms really did away with any notion of their innocence. They knew they were taking 'thymo', as we have the text messages. If everything was above board, they would have written 'thymo' or whatever they thought it was, on the forms. They did not. They consciously elected to not write down on their ASADA forms regular injections that they were taking. This is behaviour consistent with someone trying to keep information from the drug-testing agents. If they thought their 'thymo' was legit, they would have written it down. The explanation is that they were at least partially complicit in the program. The lack of disclosure damns the players. I acknowledge those running the program hold the bulk of the blame, and yes they were obligated to provide a safe workplace. But the players are not blameless victims. Zaharakis demonstrated that it was possible to not engage with the program.

  7. Agreed. It's further compounded by the text messages between some of them asking if they 'go their thymo' injection yet. Text your teammate to ask if they got their shot, but not write down the shot on the disclosure form? I reckon the players have gotten off very lightly, the media could have gone very hard but didn't.

  9. Your ability to misrepresent posts is bordering on Saty levels here mate. BB referenced brown paper bags, a clear jab at the AFL's record of looking the other way at third party deals such as Judd and Visy. This demonstrates that the AFL 'has form' with regards to players being remunerated outside of the salary cap, when they can find even a flimsy justification for it. It applies here because the AFL determine the salary cap, and what does and does not fall within it. The AFL, to my knowledge, have not commented on the EFC players' compensation payments, hence my original post asking if anyone had any further information on that front. I said nothing about the AFL being complicit in the 'payments and level of those payments'.
  10. We don't know what the extent of the EFC's involvement with the negotiations are. They've been dishonest to such a point before, where I wouldn't be surprised if they were able to arm players going into negotiations with the insurer (assuming they are not party to it). Their premiums are going to skyrocket anyway. In fact I'm not sure how they're still insured at all, must be one hell of a premium increase.

  12. No, it's not. You can't continue to work while receiving an ongoing worker's comp claim. An employer with an employee on worker's comp doesn't have a 'salary cap' that they could wring out an advantage of by inflating the compo. This isn't like worker's comp. These are settlement talks to avoid civil litigation, and as such they are a negotiation. The notion that the EFC could tank/influence these negotiations in order to pay their players less inside the cap and retain them all, when they otherwise couldn't, is valid (at least in my opinion). Edit: The amount of players they have retained doesn't pass the smell test. Something is fishy, and I suspect this has something to do with it.
  13. Sigh. Because it gives the EFC an opportunity to subvert the salary cap. In an idea world, you'd be correct and neither would have anything to do with the other. However, I don't trust the EFC not to tank their negotiations in to compensate for a lower payment to a player under their salary cap. Their insurance premiums are going to skyrocket anyway. I'm also extremely sceptical given they've managed to hold onto so many players who are launching action against them. It makes very very little sense to me as to why someone would stay with an employer who they are suing for compensation. I think there's more going on. Call me an idiotic conspiracy theorist, but basically, I don't trust them.

I mean, I'm sure the EFC is a fine upstanding organisation that would never bend or break rules, but we've discussed previously that this presents an opportunity to subvert the intention of the salary cap if these payments aren't included.
  15. What further astounds me is that even if one subscribed to the 'players are victims' narrative, then the EFC is surely the perpetrator? The lack of outcry against the EFC continually astounds me. My only explanation is that the players' lawyers have told them to keep quiet until settlement talks have concluded.
