Apparently his argument is that he didn't get a fair hearing, but his lawyer said he had a fair hearing at the CAS.

Shortest appeal ever? Won't even make it past the first step.

Jess said his client could not have done any more to check the validity of the substances he was injected with.

“He was in front of Doc Reid twice and asked him twice, `Is there an issue?’ and both times Reid replied that it won’t do you much good but it won’t do you any harm.’

“As a consequence he was a part of (the injection regimen). If you asked your doc twice, what part of due inquiry are we missing.”

Based on reports I have read about the queries NLM made to Reid, Jess seems to be dealing with different sets of injections. In any event, the CAS Arbitral Award dealt with this issue. Further, NLM's Counsel at CAS did not object to the jurisdiction, procedures or fairness of the hearing both at its commencement or conclusion.

If the cost of such an appeal is to be borne by the AFLPA, if I was a player I would be outraged at the use of association funds for this futile exercise. 

On that note, there have been numerous exercises in futility over the course of this long running saga, but this would have to be the most futile. 

The only benefit it would seem to have is free publicity for a player manager and more opportunities for the media to discuss the situation and in Robbo's case erroneously and ad nauseum.

The appeal costs being borne by ALFPA means it is being paid for by the AFL (who 100% fund it).  As a fan I am outraged the AFL using monies that should go to clubs or game development elsewhere for this futile exercise.  If all AFL players funded their union (the AFLPA) then they would be complaining loudly.  As long as it is other people's money ie the AFL's no-one says anything.

If Essendon is supposedly supporting all 34 players why is it not funding appeals, I wonder.  A rhetorical question, I know but that is where the funding responsibility really lies. 

WJ, do you have any idea why other clubs are not up in arms about all the favours the AFL is giving EFC?

That could explain why the AFL is happy to fund the AFLPA. To minimise the chance of dissent.

You are so right TedF!  Machiavellism in the extreme!

For the part above that is highlighted:  that sounds like MFC's predicament of recent years and some to come...the AFL determined to maintain the status quo:  Fete the rich and powerful regardless of their crimes and shackle the weak.

I despair at the state of the game and the connivance of the people supposedly 'managing' it.

But how would CAS, which only came into the picture late in the process, even have the opportunity (let alone the motive) to do so? On the other hand, if it can be shown that either ASADA or WADA doctored evidence...well, then the appeal's going to happen, isn't it?

Robbo was pathetic on the radio yesterday. He seriously had trouble putting a sentence together.

An update:  I was just listening to SEN and a comment from Paul Marsh of the AFLPA answered my question above about EFC funding appeals.  He said the AFLPA won't be funding anything and are in discussions with EFC to fund appeals if any. 

He went on to say if Peter Jess believes the AFLPA will fund his appeal for NLM it shows 'how disconnected' he really is from the process.  Peter Jess seems to come out with a new thought bubble each day...it is losing him more credibility each day.

Obviously they couldn't, they're a court. But then Robbo thought there were four judges on the CAS bench.

Maybe the mysterious fourth was a specialist they brought in, a Doctor of Evidence. Sounds impressive. I think I'll add that to my qualifications.

I heard Robbo on SEN and seriously he was almost incoherent. He sounded smashed. It was appalling and you could tell Allen and Harford were embarrassed. Id be sacked if i spoke in an official capacity like that. 

The article he wrote on the subject was trash, containing not a single logical reason why Watson should not lose the brownlow. Not one. His main thrust is that he is not comfortably satisfied that CAS's comfortable satisfaction the players took banned drugs is sufficient reason for stripping him of the brownlow ie it doesn't prove he is a drug cheat. The other argument is that the AFL have said all along they want to protect the players and now they have the chance. Is he for real? 

His radio spot was even more random, including the CAS doctoring evidence comment and a long ramble about how impossible the CAS judgement was to read with all of its legalese etc (a document that though long and detailed has been praised for its clarity by John Fahey and others). He clearly hasn't even read it and he is coomenting on the case. Beggars belief.

    ICEBREAKER by KC from Casey

    The Casey Demons have broken the ice for season 2024 with a pulsating come-from-behind victory over Port Melbourne in which it took the lead for the first time at the halfway mark of the final quarter. The game played in mild Autumn conditions in neutral territory at Kinetic Park, Frankston, never reached great heights in standard but it proved gripping in character at the end at the Casey Demons overcame the Borough to win by 15 points after trailing badly early in the second half.  P

    The writing was on the wall from the very first bounce of the football. The big men went up, Max Gawn more often than not, decisively won the ruck hit out and invariably a Brisbane Lions onballer either won the battle on the ground or halved the contest and they went at it repeatedly until they finally won out. Melbourne managed the first goal from Alex Neal-Bullen but after that the visitors shut out every area of Demon presence around the ground except in the ruck duels. It was a mauling.
